STAMPIN’ UP! PAPER PUMPKIN TERMS AND CONDITIONS


Key Information for Paper Pumpkin Subscription

If you have selected a ‘Pay As You Go’ plan then your subscription contract will continue unless you take steps to bring the contract to an end. If you have selected a 3, 6 or 12 month ‘Pre-Pay’ plan then your subscription contract will continue for that fixed term, unless you take steps to bring the contract to an earlier end.

Until the contract comes to an end you will continue to incur liabilities under the contract. You may give notice to terminate your contract at any time. There is no minimum period that must elapse before you can bring the contract to an end.

Payments under your contract are made monthly. The minimum amount that you will be liable to pay each month will depend upon the number of kits that you have selected to have delivered to you each month. Your monthly pricing is shown on this Checkout page.

If you have selected a ‘Pay As You Go’ plan then payment for your first Kit is due at sign-up. You may cancel Your ‘Pay As You Go’ plan at any time; cancellations must be made on or before the 10th day of the month to avoid being charged for the upcoming monthly kit, subject to which the minimum total amount for which you will become liable under the contract is the cost of your first kit.

If you have selected a 3, 6 or 12 month ‘Pre-Pay’ plan then, subject to your cancellation rights, the minimum total amount for which you will become liable under the contract is the cost of your monthly kits for each month for which you have subscribed.

Your contract permits Stampin’ Up! to change the frequency and the amount of your payments under the contract. We will give you notice of any such proposed change and you will have 30 days to reject the change and cancel your contract; changes will take effect on the billing cycle following the expiration of the 30 days’ notice.

You may cancel your contract at any time using the same method you used to sign up, or by following the instructions found by clicking the clearly labelled ‘Cancel Subscription’ button found in your account settings. If you have selected a ‘Pay As You Go’ plan then you must cancel before the 10th day of the month to avoid being charged for the upcoming monthly kit. If you have selected a ‘Pre-Pay’ plan then Stampin’ Up! will not refund any pre-payments made if you cancel your contract after the 10th day of the month following the date of your subscription.

The above contractual cancellation rights do not affect your statutory rights. You have a statutory ‘initial cooling-off period’, during which you may cancel your contract without any penalty, which expires 14 days after the day on which you receive your first kit. Pre-Pay Plans do not automatically renew, but may of course be renewed voluntarily, and so no statutory ‘reminder notices’ are issued. These Terms and Conditions ("Terms") govern your subscription to Stampin’ Up!’s monthly Paper Pumpkin subscription (“Service”) and are entered into by and between Stampin’ Up! UK Limited (“Stampin’ Up!” or “We”) with a registered office located at Mercury House, 19-21 Chapel Street, Marlow, Bucks, SL7 3HN, United Kingdom, and You (“You” and “Your”), as either a Stampin’ Up! Demonstrator (“Demonstrator”) or as a retail customer (“Customer”) subscribing to the Service.

If You are a Customer all product sales under the Service are made to You by a Demonstrator, who acts as the authorised distributor of Stampin’ Up! products. Stampin’ Up! will process Your purchase transaction on behalf of the Demonstrator who is selling the products to You. If You have not selected a Demonstrator, Stampin’ Up! will assign You one based on Your location; the details of that Demonstrator will be notified to You and the sale will be completed through that Demonstrator.

For product sales to Customers, Stampin’ Up! acts solely as the administrative and payment processor for sale transactions and does not sell products directly to Customers. These Terms govern the Service only and do not alter the underlying product sale contract between You and the Demonstrator. Your Demonstrator will sell Your products to You on the then-current standard terms of sale which are the ‘General Purchasing Provisions for Customers’ section of the General Ordering terms located on Stampin’ Up!’s website and available at the following link Stampin' Up!.

If You are a Demonstrator all product sales under the Service are made to You by Stampin’ Up! We will sell the products to you on the terms of sale set out in Your Independent Demonstrator Agreement including the Stampin Up! Policies which form part of that Agreement. These Terms govern the Service only.

The Service is governed by these Terms and these Terms supersede and replace any previous Stampin’ Up! Paper Pumpkin Terms. By subscribing You acknowledge that You have read and agree to be bound by the Terms. If You do not agree to these Terms, do not subscribe to the Service.

Demonstrators should refer to their Independent Demonstrator Agreement including the Stampin Up! Policies which form part of that Agreement for details of their rights and applicable purchasing provisions.

DEFINED TERMS

Service: Monthly Paper Pumpkin kit (“Kit”) delivered to a specified address. Each kit includes materials and instructions to create crafting projects, and may include, without limitation, handmade cards, tags, and more. Shipping costs are included as part of the Service fee.
Pay-as-You-go:A monthly subscription to the Service that automatically renews each month to ensure uninterrupted access.
Pre-pay: A subscription for 3, 6, or 12 months of the Service paid for in advance. Pre-pay ensures delivery without the need for payment of individual monthly billing invoices and does not automatically renew.

ELIGIBILITY

By subscribing, You represent that You are not a minor, and that you understand and agree to be bound by these Terms.

PAYMENT LIABILITY

Pay-as-You-go. Payment for Your first Kit is due at sign-up. The Service automatically renews on the 11th day of each month. You will be required to provide a separate one-time express informed consent to these recurring charges at the time of Your subscription to the Service. At the time of automatic renewal, the payment method you provided to Stampin’ Up! will be charged for the upcoming monthly Kit. Stampin’ Up! will send a reminder email to the email address You provided at the time of subscription at least 5 days prior to renewal with a link for you to manage or cancel Your Service.

Pre-pay. A single payment is due at the time of purchase for the total price of the subscription You selected. You may cancel your Pre-pay Service at any time, but, subject to your statutory rights, the pre-payment made under a Pre-pay Service is non-refundable if you cancel for your own convenience more than 14 days after the date upon which you receive your first Kit.

CANCELLATON AND REFUNDS

You may cancel Your Pay-as-You-go Service using the same method You used to sign up, or by following the instructions found by clicking the clearly labeled ‘Cancel Subscription’ button found in Your account settings. It is not required to call or email to cancel, but you may do so if you wish. Cancellations must be made on or before the 10th day of the month to avoid being charged for the upcoming monthly kit. As noted below, this does not affect Your right to cancel the Service at any time, but cancellation after the 10th day of the month may mean that the monthly charge will be made and then refunded.

Upon providing You with a 30-day advance written notice, Stampin’ Up! may cancel Your subscription. If Stampin’ Up! cancels your subscription then any pre-payments for kits not yet delivered to you will be refunded in full.

You may cancel any Pre-pay 3, 6, or 12 month Service at any time, but, subject to your statutory rights described below, the pre-payment made under a Pre-pay Service is non-refundable if You cancel for your own convenience more than 14 days after the date upon which you receive your first Kit.

MANAGING YOUR SUBSCRIPTION

You may pause Your Service on a monthly basis by selecting the skip option on the Subscription page when logged into Your account on the Stampin’ Up! website (“Website”). An election to skip a month must be made on or before the 10th day of the month. Choosing the skip option pauses Your Service for only the month indicated when skipping. Service will automatically resume the following month.

GIFTED SERVICE

A Service may be purchased by You and delivered to a third-party recipient (“Gift Recipient”). You retain full control over the Service, including payment, renewal, and shipping details. The Gift Recipient will receive the Kit but cannot manage the Service.

By purchasing a Service as a gift, You represent that You have the Gift Recipient’s consent to share their name and address, which will be used solely to fulfill the Service in accordance with Stampin’ Up!’s Privacy Policy.

You acknowledge that beyond shipment and as otherwise may be required by law, Stampin’ Up! has no other obligation to the Gift Recipient. Notwithstanding anything to the contrary, these Terms create no third-party beneficiary rights.

SHIPPING AND DELIVERY

Kits are shipped monthly to the shipping address provided by You at purchase. Shipping costs are included in the Service fee. Delivery times may vary based on location. Shipping and delivery dates are estimates only and cannot be guaranteed. Stampin’ Up! is not responsible for delays caused by postal services or other factors beyond its control.

You acknowledge that beyond shipment and as otherwise may be required by law, Stampin’ Up!  has no other obligation to the Gift Recipient. Notwithstanding anything to the contrary, these Terms create no third-party beneficiary rights.

COMMUNICATION

By creating an account or using the Service, You will receive communications from Stampin’ Up! that may include updates about Your account, order confirmations, shipping and service notifications, and other information necessary to fulfill our contractual obligations to You.

CHANGES TO SERVICE AND PRICING

From time to time, Stampin’ Up! may modify the Service, including these Terms, including, without limitation, the price and payment, shipping and delivery, cancellation and refunds, gifted service and monthly skip options, and eligibility and qualifications, by providing You with reasonable notice, or as otherwise required by law. After receiving notice, You will have 30 days to reject any such modifications by cancelling Your Service. Changes will take effect on the billing cycle following the expiration of the 30-day advance notice.

Stampin’ Up! may suspend or terminate the Service and/or Your Subscription to the Service at any time and for any lawful reason by providing You with 30 days advance notice, or as otherwise required by law. If the Service is terminated by Stampin’ Up! then outstanding pre-paid Services will be fully refunded for the remaining Service period.

PRIVACY AND DATA PROTECTION

You are responsible for ensuring that the information in Your profile is accurate and remains current. Stampin’ Up! is not responsible for inaccurate information provided by You. For information on how We handle personal information, please see the Privacy Policy.

LIMITATIONS OF LIABILITY

TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT WILL THE COLLECTIVE LIABILITY OF STAMPIN’ UP! AND ITS SUBSIDIARIES AND AFFILIATES, AND THEIR DIRECTORS, OFFICERS, EMPLOYEES, LICENSORS, SERVICE PROVIDERS, AGENTS, AND TO ANY PARTY (REGARDLESS OF THE FORM OF ACTION, WHETHER IN CONTRACT, TORT, OR OTHERWISE) EXCEED THE AMOUNT YOU HAVE PAID TO STAMPIN’UP! FOR ANY GOODS OR SERVICES IN THE LAST 12 MONTHS.

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, NO RESPONSIBILITY OR LIABILITY IS ASSUMED BY STAMPIN’ UP! FOR TECHNICAL PROBLEMS OR TECHNICAL MALFUNCTIONS ARISING IN CONNECTION WITH THE OPERATION OF THE WEBSITE OR THE SERVICE.

THE FOREGOING DOES NOT AFFECT ANY LIABILITY THAT CANNOT BE EXCLUDED OR LIMITED UNDER APPLICABLE LAW.

DISPUTE RESOLUTION

All matters relating to these Terms, and any dispute or claim arising therefrom or related thereto in each case, including non-contractual disputes or claims, will be governed by and construed in accordance with the laws of England without giving effect to any choice or conflict of law provision or rule.

Any legal suit, action, or proceeding arising out of, or related to, these Terms, the Service, or the Website will be instituted in English courts. You waive any objections to the exercise of jurisdiction over you by such courts and to venue in such courts.

GENERAL PROVISIONS

No waiver by Stampin’ Up! of any term or condition set forth in these Terms will be deemed a further or continuing waiver of such term or condition or a waiver of any other term or condition, and any delay or failure of Stampin’ Up! to assert a right or provision under these Terms will not constitute a waiver of such right or provision.

If any provision of these Terms is held by a court or other tribunal of competent jurisdiction to be invalid, illegal, or unenforceable for any reason, such provision will be eliminated or limited to the minimum extent such that the remaining provisions of the Terms will continue in full force and effect.

You may not assign, novate, delegate, or otherwise transfer any of Your rights or obligations under these Terms without the prior written consent of Stampin’ Up!, which consent Stampin’ Up! may grant or withhold in its sole and absolute discretion.

You agree that these Terms constitute the entire agreement between You and Stampin’ Up! arising out of or relating to the Service, and supersede all prior and contemporaneous understandings, agreements, representations, and warranties, both written and oral, arising out of or relating to the Service.
